Scope of Work: All services are delivered according to explicitly contracted Statements of Work (SOW) executed between the client and PixelFormix. Each SOW specifies deliverables, timelines, milestones, and payment terms.
Intellectual Property: Upon complete settlement of agreed commercial invoices, PixelFormix assigns all worldwide intellectual property rights in client-specific deliverables, including source code, design tokens, and digital assets, directly to the client.
Payment Terms: Invoices are due within 14 calendar days of issuance unless otherwise specified in the SOW. Late payments incur a 1.5% monthly interest charge. Projects may be paused for accounts more than 30 days past due.
Delivery Timelines: Estimated delivery timelines are provided in good faith and are subject to client responsiveness, feedback turnaround, and scope stability. Delays caused by client-side factors may extend delivery dates proportionally.
Liability Limitation: PixelFormix's total liability under any engagement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Confidentiality: Both parties agree to maintain the confidentiality of proprietary information exchanged during the engagement. This obligation survives termination of the agreement for a period of 3 years.
Refund & Reimbursement Policy — Security Audits
PixelFormix maintains a transparent refund and reimbursement policy for all services rendered. This policy is effective for all engagements initiated from the date of publication.
Pre-Project Cancellation: If a project is cancelled before work has commenced, a full refund of any advance payment will be issued within 14 business days. Cancellations must be submitted in writing to [email protected].
Mid-Project Cancellation: For projects cancelled after work has begun, the client is liable for payment of all work completed up to the cancellation date, calculated proportionally based on the approved SOW milestones. Any advance payment exceeding work completed will be refunded within 14 business days.
Non-Delivery Guarantee: If PixelFormix fails to deliver agreed-upon deliverables as specified in the SOW due to circumstances within our control, the client is entitled to a full refund of fees paid for undelivered work items. This guarantee excludes delays caused by client-side factors or force majeure events.
Quality Assurance: All deliverables undergo rigorous internal QA before client review. If deliverables materially deviate from the approved SOW specifications, PixelFormix will rectify issues at no additional cost within a 30-day remediation window.
Dispute Resolution: Any disputes regarding refunds will be resolved through good-faith negotiation. If resolution cannot be reached within 30 days, disputes will be submitted to the competent courts of Annecy, France, in accordance with applicable French commercial law.
